Terms and Conditions

Karndean Training Academy training courses terms and conditions

The terms and conditions and a Booking Form constitute the entire Agreement between us.

You may submit a Booking form to us via;

  • online form
  • email at training@karndean.co.uk
  • in writing to The Training Academy, Karndean Designflooring, Crab Apple Way, Evesham WR11 1GP
  • When you submit a booking form this constitutes an offer by you to book a course


We will send you written confirmation of your booking and this will create a legally binding contract between us.

If for whatever reason you need to change the delegate, please inform us as soon as is reasonably possible but please note that special requirements cannot be ensured if insufficient notice is given.

We do not provide accommodation for our courses but we may provide information concerning locally available accommodation options. We accept no liability for the information provided or for any bookings made with accommodation providers. IMPORTANT - In the event of a course cancellation for whatever reason You will be responsible for rearranging or cancelling Your accommodation.

Prices are as stated on the booking form and include a light lunch each day. Travel, accommodation and any other costs incurred by you in connection with the course are not included in the price.

Payment

Karndean credit account customer; payment for the booking is required in line with our normal payment terms.

Non-Karndean credit account customer; payment must be received at the time of booking to confirm your place.

Transfers/change of delegates

A change of delegate(s) is permitted by giving prior notice to Karndean but bear in mind that we may not be able to meet any special requests made at short notice and that any additional costs incurred by yourselves including but not limited to accommodation bookings and subsistence will be paid by yourself or your nominated delegate.

Cancellations made by Karndean. In the event that Karndean is forced to cancel a training session for whatever reason you will be entitled to a full refund which can be paid by BACS or raised as a credit to Karndean credit account. Refunds /credit will only be made to the person or entity making the original booking.

Cancellations made by you. All cancellations must be in writing. For bookings cancelled at least 10 working days prior to the course date we will credit the fee paid to your Karndean credit account. For delegates/companies without a Karndean credit account we will make a refund less our admin charge of £25 plus VAT.

Bad Behaviour, Drugs, Health and Safety.

You shall be responsible for and (if you are a business) agree to indemnify us in respect of, any loss, damage or injury caused to the property of us, our employees or any third party by the conduct, act or omission of your delegate(s). Delegates must comply with all the rules, procedures, policies and guidelines in place at our premises, including but not limited to health and safety and security procedures.

We will not tolerate delegates bringing alcohol, illegal substances or any object that can be used as a weapon (other than those tools required for the fitting course) onto our premises. Any delegates found to be in contravention of this clause will be asked to leave the course and premises immediately with no refund or compensation made.

Similarly, if we believe a delegate is under the influence of illegal substances, alcohol or if a delegate exhibits any threatening behaviour to any other person, that delegate will be required to leave the course and premises immediately with no refund or compensation.

Certificates

On completion of each course you may be awarded a certificate stating your attendance and completion of said course. Note that this is not an accredited qualification and to hold yourself out as a ‘qualified Karndean installer’ or similar, is not allowed at any time either before or after attending any of our courses. You may advertise your attendance at said course(s) but nothing in your attendance shall permit you to claim any qualification or accreditation by Us.

If you do not hold a Karndean credit account, attendance on our course(s) does not entitle you/the enterprise that you represent yourself or your business as being a Karndean retailer/partner or that you are in any other way affiliated with Karndean.

Data Protection

This clause sets out the responsibilities of Karndean and the Customer in relation to the General Data Protection Regulation and any other applicable data protection law. Where Karndean processes any personal data in relation to services or products covered by these terms and conditions, it does so as a data controller on its own behalf (including in order to comply with its obligations and exercise its rights under this agreement) and shall comply with data protection law in respect of such processing. Where you provide any personal data in relation to this agreement, you warrant that you do so in compliance with data protection law and that Karndean may, under data protection law, process such data as required or anticipated by this agreement, and you shall be responsible for any costs, losses or expenses Karndean incurs or suffers as a result of breach of such warranty.

Karndean will use personal information about customers for the purposes of:

  • providing access to and use of training services to customers;
  • providing customer support, billing and other similar activities related to the provision of training services; and
  • keeping customers informed about products, services, offers and upcoming events and to improve Karndean’s services.

Intellectual Property

Use of Intellectual Property, (Karndean’s rights including but not limited to; Trade Marks; logos; copyrighted photography; domain names; design rights (IP)) – No delegate shall be permitted to use any Karndean IP either prior to or after attending Our course(s), whether for their own use or for their enterprise without prior written permission from Us. Any IP made available to you during the course shall remain the property of Karndean and all rights in all IP shall remain vested in Karndean or its licensor.

Karndean shall be permitted to use photographs of delegates attending the course(s) for whatever reason and in whatever media and consent for us to do so is given as part of the contract.

Special requestsWhile we will endeavour to meet all special requests in respect of timings, dietary requirements we accept no liability for any requests that cannot be met for whatever reason. We will make all reasonable efforts to inform you in advance of your course starting if we are unable to meet your special request to enable you to make alternative arrangements.

General

Karndean reserves the right to vary delivery of the programme and to change tutor or course content where the occasion necessitates.

Prices may be subject to change.

Liabilities

To the maximum extent permitted by law, Karndean shall not be liable for any loss, injury, claim, liability, or damage of any kind resulting in any way from:

  • any errors in or omissions from the provision of training services.
  • the content of courses and/or materials, whether delivered face-to-face or online;
  • any delay or failure in performance caused by reason of an act, event, non-occurrence, omission or accident beyond Our reasonable control; or
  • any negligence of Karndean or its employees, contractors or agents in connection with the performance of its obligations.

The aggregate liability of any claim arising out of or in connection to the provision of training services shall not exceed three times the amount of course fees paid by the customer for any one course.

Karndean’s liability to the customer for loss or damage of any kind (including loss or damage caused by negligence) is reduced to the extent that the customer caused or contributed to that loss or damage.
